Titanmind (“us”, “we”, or “our”) operates the https://www.titanmind.so website and related mobile applications (collectively, the “Service”), an AI-driven platform for customer engagement via WhatsApp, SMS, email, and webchat. By accessing or using the Service, you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy, accessible at https://www.titanmind.so/privacy-policy. If you do not agree, you must not use the Service.

Use of the Service

You may use the Service only for lawful business purposes, such as creating and managing marketing campaigns, in compliance with these Terms, applicable laws (e.g., India’s Digital Personal Data Protection Act, 2023, and anti-spam regulations), and third-party platform policies (e.g., WhatsApp Business API terms). You must be at least 18 years old or have legal authority to enter into these Terms on behalf of your organization. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@titanmind.so if you suspect unauthorized access.

You agree not to use the Service to:

  • Send spam, unsolicited messages, or content that is unlawful, defamatory, or infringing on third-party rights
  • Reverse-engineer, decompile, or attempt to access the Service’s underlying AI technology
  • Interfere with the Service’s functionality or security Violation of these Terms may result in suspension or termination of your account without notice.

Ownership and Use of Content

You retain ownership of all content you upload, create, or submit to the Service, including contact lists, campaign templates, message drafts, and customer data (“User Content”). By uploading User Content, you grant Titanmind a worldwide, non-exclusive, royalty-free, transferable license to use, store, process, and display such content solely to provide and improve the Service, including executing campaigns and generating analytics. This license terminates when you delete your User Content or close your account, except where retention is required for legal or backup purposes. You are responsible for ensuring User Content complies with applicable laws, including obtaining recipient consents for marketing communications, and does not infringe third-party rights.

Content provided by Titanmind, including AI-generated templates, analytics reports, and Service interfaces (“Titanmind Content”), is owned by Titanmind or its licensors and protected by intellectual property laws. You may use Titanmind Content solely for your internal business purposes within the Service. Reproduction, modification, or distribution of Titanmind Content without our written consent is prohibited. Titanmind reserves the right to remove User Content that violates these Terms or applicable laws.

Privacy and Data Protection

We collect and process data to deliver and enhance the Service, as detailed in our Privacy Policy. This includes:

  • Personal Data: Name, email, phone number, payment details, company information
  • User Content: Contact lists, campaign data
  • Usage Data: IP address, browser type, device identifiers, campaign metrics
  • Cookies: For analytics and personalization (configurable via browser settings)

Data may be stored on secure servers (e.g., Amazon Web Services) outside India, with safeguards to ensure compliance with data protection laws. You have rights to access, rectify, erase, or restrict your data, as outlined in our Privacy Policy. Contact support@titanmind.so to exercise these rights.

You must obtain necessary consents from individuals whose data you upload (e.g., for marketing campaigns) and comply with regulations like India’s DPDP Act or GDPR (if applicable). Titanmind is not liable for your failure to secure consents or for data breaches caused by your actions.

Third-Party Integrations and Links

The Service integrates with third-party platforms, such as the WhatsApp Business API, payment processors (e.g., Stripe) and analytics tools (e.g., Google Analytics), to facilitate campaign execution and Service functionality. We also may include links to third-party websites or services. These third-party services are not controlled by Titanmind, and we do not endorse or assume responsibility for their content, privacy policies, security, or compliance. Your use of third-party services is at your own risk and governed by their terms and policies, which you should review.

Titanmind is not liable for damages or losses arising from third-party services, including data breaches or service interruptions. For issues with third-party platforms, contact their providers directly. For Service-related concerns, reach out to support@titanmind.so.

AI Agent Communication

The Service uses AI agents to automate customer engagement via WhatsApp, SMS, email, and webchat. You agree to:

  • Use AI-driven campaigns for lawful purposes only
  • Obtain recipient consents as required by law (e.g., TRAI regulations in India)
  • Comply with third-party platform policies
  • Avoid sending spam or harassing content

Titanmind does not guarantee message delivery, campaign performance, or accuracy due to factors like network issues or third-party restrictions. You are responsible for the quality and legality of User Content used in campaigns. Misuse may result in account suspension.

Subscription and Payment

Use of the Service requires a paid subscription, subject to fees outlined at https://www.titanmind.so/pricing. You agree to provide accurate payment information and authorize recurring charges for your subscription plan. Fees are non-refundable except as required by law. Payment processing may take 24-48 hours, and Service access activates upon confirmation. For billing disputes, contact support@titanmind.so within 30 days of the transaction.

Limitation of Liability

The Service is provided “as is” without warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose. Titanmind is not liable for any damages, including but not limited to incidental, consequential, or lost profits, arising from Service use or inability to use it, even if we are informed of such possibilities. Our total liability shall not exceed the fees paid by you for the Service in the preceding 12 months.

Indemnification

You agree to indemnify and hold Titanmind, its affiliates, and employees harmless from any claims, losses, or liabilities arising from your use of the Service, including third-party claims related to your User Content or campaigns.

Termination

We may suspend or terminate your access to the Service for violations of these Terms, non-payment, or suspected fraudulent activity, with or without notice. Upon termination, your right to use the Service ceases, but obligations regarding User Content and indemnification survive.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in courts located in Gurugram, Haryana, India. You agree to attempt informal resolution by contacting support@titanmind.so before pursuing legal action.

Changes to Terms

We may update these Terms periodically. Changes will be posted at https://www.titanmind.so/terms with an updated effective date. We may notify you via email or a Service notice. Continued use of the Service after changes constitutes acceptance.
